Terms and Conditions
ARTICLE 1 - PURPOSE OF THE CONTRACT
The parties declare that the present lease is not for the purpose of renting premises for main residential use or mixed professional and main residential use, nor for the purpose of professional or commercial activity.Consequently, they agree that their respective rights and obligations will be governed by the stipulations of the present contract, by the modified decree of December 28, 1976 and, failing that, by the provisions of the civil code.The premises subject to this contract are rented furnished on a seasonal basis.
ARTICLE 2 - DESCRIPTION OF THE PREMISES

2. Consistency of the leased premises :
On a plot of 12,994 m2 , several buildings including the Governor's House, the Guest House, the Watchtower and several Cottages offer a useful living area of 1,290 m2 . In addition, there is a private swimming pool and natural pond, as well as extraordinary gardens. The gardens and the property are protected. The property is fully furnished and equipped according to a description attached (Appendix B).
Maximum number of guests : 24.
STAFF:
Several employees are assigned to the maintenance and permanent preservation of the spaces(gardener, technician and cleaning lady), these employees may be required to intervene on the property during the rental period, without recourse against the Lessor.
ARTICLE 3 - DURATION
This contract is entered into for a certain period. In no case may it be extended, except with the prior written consent of the Lessor. The initial contract and the extended contract may not extend the duration of the lease to more than ninety days. At the beginning of the rental period, the Lessor shall give the Tenant the keys and instructions for the accommodation.
SECTION 4 - RENT AND OTHER CHARGES
The present rental is accepted and agreed upon for the amount notified in the contract - including the rent, the tourist tax, the end of stay cleaning and the household linen: bed sheets and towels - payable at the time of reservation as a reservation deposit (50% of the amount of the rental), by bank transfer to the order of the Lessor LE GRAND JARDIN on the day of the signature of the contract. The balance will be paid in the same way 45 (forty-five) days before the effective date of the rental. In the case of a reservation before the deadline of 45 (forty-five) days before the effective date of the contract, the amount of the rent will be due in full. The above rent includes, for the entire duration of the lease, the payment of the rental charges and the available equipment listed below:- Water, Gas, Electricity, Heating, Air Conditioning, Internet line, Television
** DECLARATION AND PAYMENT OF TOURIST TAXES FROM 01/01/2019:
since 1st January 2019, the real tourist tax is compulsorily collected by the intermediary payment operators on behalf of non professional renters. NB: if, due to the state of the house, it is necessary to spend more than 8 hours for the cleaning, each additional hour will be charged to the tenant on the basis of 500 € (five hundred euros) per hour. This additional cost will be deducted from the security deposit if necessary.
ARTICLE 5 - SECURITY DEPOSIT
As a guarantee of the whole execution of its obligations and in guarantee of the damages which could be caused in premises, furniture, equipments, materials, and object furnishing the places, the tenant will pay 45 DAYS (forty-five) before his arrival a sum of 15,000 € (fifteen thousand euros). This sum will not be productive of interests. This deposit will be returned to the Tenant within a maximum period of 1 (one) month from the date of the end of the rental period, after deduction of the sums that could be due by the Tenant for rental repairs and sums covering damage and/or deterioration of the accommodation and furniture and objects in the accommodation caused by the Tenant, as well as the loss of keys or objects.
ARTICLE 6 - INVENTORY REPORT
An inventory of fixtures and an inventory of the furniture made available are given to the Tenant at the time of entry into the accommodation. The tenant will have 24 hours (for a stay of one week) and 48 hours (for a stay of more than one week)to contest and contradict with the Lessor the inventory of fixtures which will be given to him at his arrival. If the tenant does not contest the inventory of fixtures within the time limit indicated, the inventory of fixtures will be considered approved and validated by the tenant. On the basis of this inventory of fixtures, the Tenant shall be responsible for any damage or loss that may occur to the movable objects during the rental period. An inventory of fixtures and an inventory will be established by the Parties at the end of the lease, each will keep a copy initialed and signed.The full inventory is listed here and by signing the rental contract, it is considered accepted.
ARTICLE 7 - GENERAL CONDITIONS
This lease is made upon the following terms and conditions which the Tenant agrees to perform and carry out, namely:
- To take the rented premises in the state in which they will be at the time of the handing-over of the keys and such as they will have been described in the inventory of fixtures, with the furniture, equipment and materials and objects furnishing them such as they will have been described in the inventory.
- To occupy the premises according to the contractual destination, the exercise of any trade, profession or industry being formally prohibited.
- To enjoy the rented premises in a reasonable manner. The lessee shall not do anything or allow anything to be done that may damage the leased premises. The Tenant shall immediately notify the Landlord of any damage to the property or any deterioration of the rented premises of which theTenant may have knowledge.
- The property being in a protected area, it is forbidden to make fires outside of the places provided for this purpose and the Tenant shall make every effort to respect the surrounding fauna and flora.
- Respect the tranquility of the neighbourhood by limiting noise pollution as much as possible and by ensuring that the tranquility of the continuous strip of property is maintained.
- Pay the rent on the agreed terms.
- Be responsible for any damage or loss that may occur during the term of the lease in the premises which he/she has exclusive use of, unless he/she can prove that they were caused by a case of force majeure, by the fault of the Lessor or by the act of a third party whom he/she did not introduce into his/her dwelling. The furniture, equipment, materials and objects which are missing or damaged or which have been put out of service, for a reason other than normal wear and tear, shall be replaced in an identical manner with the consent of the Lessor, or paid for at the price of identical replacement.
- Not to substitute any person whatsoever, nor to sublet the premises, even free of charge, except with the express agreement of the Lessor.
- Refrain from throwing objects or substances into the pipes that may block them, failing which theTenant shall be liable for the costs incurred in repairing and restoring the pipes.
- To let execute in the rented places the works of which the urgency and the necessity would appear during the course of the rent, without being able to claim any compensation.In the event that the Tenant uses external concierge services, whether on an ad hoc basis or for the entire duration of the rental, such services shall be under the Tenant's sole responsibility. In no case shall the Landlord, who accepts the principle of using such services, be associated with the services performed on behalf of the Tenant.
ARTICLE 8 - INSURANCE
The Tenant confirms that all persons present, including himself, are covered by a leading company for all damages caused to the rented premises (building, furniture, outdoor equipment, etc.).
ARTICLE 9 - RESOLUTORY CLAUSE
In the event of failure to pay the rent in accordance with the schedule set forth in Article 4 - RENT or in the event of non-performance of any of the clauses of this lease, in particular in Article 7, this lease shall be terminated as of right five days after a simple summons by registered letter that has remained unfruitful stating the Landlord's desire to make use of this clause, without the need to complete any judicial formality. If, despite this essential condition, the Tenant refuses to vacate the premises, a simple summary orderen forceable by provision will suffice to compel him to do so. The same shall apply if the Tenant remains on the premises after the lease has expired.
ARTICLE 10 - CANCELLATION
The signature of the contract commits both parties irrevocably. No termination is possible unless the parties agree in writing. If the Tenant renounces the lease, he/she remains liable for the full rent.
ARTICLE 11 - ELECTION OF DOMICILE
For the execution of the present contract and its consequences, the parties elect domicile at their address indicated at the head of the present contract.
ARTICLE 12 - IN CASE OF DISPUTE
In the event of a dispute relating to the conclusion or execution of this lease, French law alone shall apply. The Parties undertake to find an amicable solution as a priority. Failing that, the dispute will be submitted to the competent Court as for the situation of the building, namely the Courts of Cannes.

APPENDIX A: PREVENTION AND USE TIPS FOR THE POOL AND NATURAL POND
Protective devices are never a substitute for adult vigilance. None of the devices are 100% infallible.A child can drown in less than 3 minutes in 20 cm of water without making a sound:
- Never leave a young child alone near water (bathtub, pool, pond...)
- Never let a child access a pool or a pond alone, even for a few seconds, never take your eyes off them
- Exercise constant and active surveillance: a protective device never replaces your surveillance, especially since security devices only work as a protection when they are in a locked position (for barriers, covers and shelters), or in a normal operating state (for alarms)
- Systematically equip children when swimming around the pool with floats, adapted buoys, arm bands or floatation suits
- Teach children to swim from the age of 4, make them aware of the danger and forbid them to swim when you are not at their side
- Have some equipment near the pool that is immediately accessible: (poles, buoys, emergency phone number...)
- Training in life-saving techniques- Never leave toys or floating objects in the pool and remove them from the pool area to avoid the risk of falls
- Immediately reactivate the safety device after swimming to make the pool inaccessible to children
- When several adults are around the pool, designate a "lifeguard".
